TOP TEN DEADLY EVICTION MYTHS
MYTH 1: A tenant being one (1) day late on his/her rent is no big deal.
MYTH 2: A landlord must accept a late or partial rent payment or rental payments from an outside third (3rd) party on the tenant's behalf as long as the tenant offers to pay the required late fee.
MYTH 3: If a tenant has maintenance problems, it is okay to not pay the rent.
MYTH 4: Reporting maintenance problems to Code Enforcement or the Health Department is the best way to fight an eviction.
MYTH 5: As long as a tenant pays the rent with a money order, he/she does not need to get a reeipt from the landlord.
MYTH 6: It takes at least 30 days before a tenant can be legally "set out" of his/her apartment by the landlord.
MYTH 7: Eviction court hearings take about one hour.
MYTH 8: If a tenant is not out of the aprtment by the time the "3 day notice" expires, the landlord can change the locks or remove the tenant's belongings from the rental property.
MYTH 9: After an eviction action is filed against a tenant in court, if the tenant plans to move out or works out some kind of an agreement in advance with the landlord, there is no need for the tenant to attend the scheduled eviction court hearing.
MYTH 10: A tenant can usually get the landlord to drop an eviction action after it has been filed in court as long as the tenant promises to get caught up on past due rent as soon as possible (ASAP).
If you have fallen victim to one or more of these myths and/or facing eviction, Community Mediation Services of Central Ohio may be able to assist you in resolving your issues with the landlord.
